Disputes, resolved properly
Disputes cost time, money and sleep. Good litigation advice starts with an honest view of your prospects: whether to settle, negotiate or fight. Sometimes the strongest move is a well-drafted letter of demand. Sometimes it is a trial. The point is to know which, before the costs run away from you.
VDW Attorneys litigates in the Magistrates Courts of the Vaal Triangle and in the High Court, acting for individuals and businesses, whether you are bringing a claim or defending one. The practice is led by an admitted attorney of the High Court with 24 years of experience.
How we can help
- Letters of demand. Often the fastest and cheapest way to resolve a dispute, drafted to be taken seriously.
- Summons and pleadings. Instituting action and drafting the court process that frames your case.
- Motions. Opposed and unopposed motion proceedings in the Magistrates Court and High Court.
- Trials. Trial preparation and representation through to judgment.
- Contractual disputes. Breach of contract, cancellation and damages claims.
- Defending claims. If you have been served with a summons or application, we assess it and defend where there are grounds.
What to expect
- An honest assessment. Bring the documents that matter to your first consultation. We look at the merits and tell you frankly whether your case is worth pursuing, defending or settling.
- A strategy and a costs picture. Litigation has costs. We set out the likely steps, timeframes and costs involved before you commit, so there are no surprises.
- We run the matter. From drafting and filing through to appearances and trial, the matter is handled for you and you are kept informed at each stage.
Frequently asked questions
Should I litigate or settle?
It depends on the strength of your case, the amount at stake and what the other side is able to pay. A good settlement is often better than a drawn-out fight, but a weak settlement from a strong position is money left on the table. We advise you on the merits first, then on strategy.
How long does a civil case take?
A matter that settles after a letter of demand can be resolved in weeks. A defended action that runs to trial can take a year or more, depending on the court roll and the complexity of the case. We give you a realistic timeframe for your specific matter at the outset.
What will litigation cost?
Costs depend on how far the matter goes and how hard it is fought. What we commit to is transparency: you will know how fees are charged and what each stage is likely to cost before it begins. In some cases a costs order against the losing party recovers part of your costs.
Which court will my matter be heard in?
That depends mainly on the size and nature of the claim. Smaller claims are dealt with in the Magistrates Court, larger or more complex matters in the High Court. We practise in both, and we advise on the right forum as part of the initial assessment.
